OUR SAFETY COMMITMENT

BASED ON THE RENTAL AGREEMENT:

Everything on this page is drawn directly from the Self-Drive Car Rental Agreement (Document No. RA-2025-001) that you accept when you book. You can read the full document on the Rental Agreement page. If anything here differs from the Agreement, the Agreement controls.

OpenRoad Technologies, Inc. - OOPA ("OOPA") is committed to the safety of every renter, driver, and vehicle owner on the platform. These Trust and Safety guidelines summarize the safety and responsibility provisions of the Rental Agreement so you know what is expected before, during, and after every rental.

As a condition of every rental, the Renter guarantees that the Vehicle will be used for lawful purposes only and in strict conformity with all applicable Philippine laws. Breach of any obligation under the Agreement may be subject to the penalties set out in it, determined at OOPA's discretion.

I. DRIVER ELIGIBILITY AND AUTHORIZED DRIVERS

The Renter must be of legal age and hold valid identification and a driver's license. The Renter shall ensure that any driver of the Vehicle is at least 18 years of age and holds a valid driver's license.

AUTHORIZED DRIVERS ONLY:

Only persons who are expressly named in the Agreement as driver(s), and who meet the age and license requirements, are authorized to drive the rented Vehicle. If the Vehicle is driven by an unauthorized person, all insurance becomes null and void, and the Renter is fully liable for all damages.

FRAUD WARNING:

Discovery of any falsified Identification Card (ID) or Driver's License presented by the Renter shall result in immediate cancellation of the booking without any refund. The Renter shall be subject to legal action for Falsification of Public Documents.

II. RESPONSIBLE VEHICLE USE

To keep everyone safe, the Renter is not authorized to:

• Drive under the influence of alcohol and prohibited drugs;

• Drive in or across rivers or any kind of watercourses without consent from OOPA;

• Propel or tow any other vehicles, trailers, or other heavy items;

• Transport goods in violation of customs rules and regulations;

• Use the Vehicle for transporting passengers as a common carrier; or

• Lend or sublease the Vehicle.

The Renter is not authorized to have repairs made or changes done to the Vehicle and its attachments without the prior consent of OOPA.

III. VEHICLE CARE AND CLEANLINESS

• Smoking Prohibition: The Renter is strictly prohibited from smoking inside the Vehicle at all times. Violation will result in a minimum penalty of ₱3,500.00.

• Foul-Smelling Items: The Renter is not allowed to bring foul-smelling food or items inside the Vehicle. Violation will result in a minimum penalty of ₱3,500.00.

• Pets: The Renter is welcome to bring pets; however, if pet fur is scattered inside the Vehicle, or if there is any presence of urine or feces, a detailed cleaning fee will be charged:

- ₱3,500.00 for sedans

- ₱4,500.00 for MPVs, SUVs, and pick-ups

- ₱5,500.00 for vans

On return, the Renter shall return the Vehicle in accordance with the following:

• With all attachments, including tires, tools, and other items that were in or on the Vehicle upon rental, in the same condition as upon reception;

• At the predetermined time, or sooner if OOPA demands it;

• With the same amount of fuel reflected on the checklist. If not, OOPA is authorized to charge the Renter for the difference; and

• Fuel and toll fees are shouldered by the Renter, and excess fuel and toll fees are not refunded.

IV. ACCIDENTS AND INCIDENTS

In the event of a collision, crime, or accident, the Renter shall immediately notify the police, as well as OOPA. The Renter may not leave the venue until notification is done and the police have arrived, or a police report has been prepared.

REPORT WITHIN ONE HOUR:

If the Renter does not report the incident within 1 hour from its occurrence, or does not cooperate with OOPA and the authorities, the Renter is fully liable for the damage or loss and shall pay for it in full, exclusive of the insurance.

V. LIABILITY, DAMAGE, AND INSURANCE

The Renter accepts all liability for all damage to the Vehicle from the time it enters the Renter's possession until it is successfully returned to OOPA.

DAMAGE AND LOSS:

In the event of loss or damage to the Vehicle, the Renter is obligated to cover the acquisition cost of the Vehicle, daily repair rate, legal fees, and damages, which shall not be less than Two Hundred Thousand Pesos (₱200,000.00).

In case of loss or total damage, the Renter shall always be liable for a minimum of 10% of the current market value of the Vehicle regardless of its insurance coverage, payable within seven (7) days from the date of accident or loss.

Insurance Coverage

In case the Vehicle needs repair due to damage occurring while it was in the Renter's possession, the Renter may be eligible for full insurance coverage from a third-party provider, subject to approval. Claims must comply with, including but not limited to:

• Securing a police report;

• Providing a photocopy of the driver's license;

• Payment of 50% of the daily 24-hour rental rate until the Vehicle is validated as repaired; and

• Payment of a Five Thousand Pesos (₱5,000.00) participation fee.

Note: OOPA is not liable for the validity of any insurance claim, and all indemnification by the Renter is independent of any money due from insurance providers.

IMPORTANT LIMITATIONS:

• OOPA is not liable for any losses of valuables, money, or property left in the Vehicle by the Renter.

• OOPA shall not be responsible for any unforeseen happenings beyond human control (force majeure) during the rental period.

VI. TRAFFIC VIOLATIONS AND NO-CONTACT APPREHENSION (NCAP)

The Renter is responsible for all parking tickets and fines for traffic violations, and shall answer for all costs and fines in the event the Vehicle is impounded, confiscated, or otherwise encumbered.

In line with the No-Contact Apprehension Policy (NCAP), OOPA retains the contact information and rental records of all renters for a period of six (6) months from the date of return of the Vehicle. This allows OOPA to (1) identify the responsible party in case of any traffic violation captured via NCAP during the rental period, and (2) communicate with the Renter for the settlement or clarification of such violations.

VII. SECURE PAYMENTS

For your protection against fraud, payment shall only be paid to accounts under the name of OOPA or any authorized E-Wallet provided by the agents or inspection officer. Never send payment to any other account.

RESERVATIONS AND REFUNDS:

A reservation fee, including service fee and other charges, secures your desired Vehicle, and the balance is paid upon delivery or pick-up. All payments are non-refundable, but bookings may be rescheduled provided notice is given twenty-four (24) hours prior to the intended date.

VIII. DATA PRIVACY AND YOUR INFORMATION

OOPA is fully committed to protecting your personal information. All data collected is handled in strict accordance with the Data Privacy Act of 2012 (Republic Act No. 10173). This means:

1. Your information is kept confidential and secure;

2. It is accessed only by authorized personnel; and

3. It is not shared with third parties except as required by law or with your express consent.

After the six-month retention period, all personal information retained for NCAP and rental purposes is securely disposed of in accordance with data disposal best practices.

IX. CONSEQUENCES OF VIOLATIONS

The Rental Agreement sets out specific consequences for conduct that puts people or vehicles at risk, including:

• Presenting a falsified ID or driver's license: immediate cancellation of the booking without refund, and legal action for Falsification of Public Documents;

• Allowing an unauthorized person to drive: all insurance is voided and the Renter becomes fully liable for all damages;

• Failing to report an accident within 1 hour or to cooperate with OOPA and the authorities: full liability for the damage or loss, exclusive of insurance;

• Illegal parking or use not conforming to the Agreement: OOPA is authorized to take possession of the Vehicle at its discretion and without notice;

• Returning the Vehicle late without any advice: OOPA is bound to report the Vehicle as missing to the appropriate authority within 24 hours; and

• Breach of any obligation under the Agreement: a minimum penalty of One Million Pesos (₱1,000,000.00), without prejudice to other reliefs based on law and equity, determined at the sole discretion of OOPA.

GOVERNING LAW:

These matters are governed by the laws of the Republic of the Philippines. The Renter shall defray all court costs, including attorney's fees, and for all claims, interest shall accrue at 2.5% a month without need for demand.

X. REPORTING AND CONTACT

If you experience a safety issue, suspected fraud, or an incident during a rental, contact OOPA Support as soon as practicable.

SAFETY COMMITMENT

BY BOOKING AND USING OOPA, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE SELF-DRIVE CAR RENTAL AGREEMENT, AND YOU COMMIT TO UPHOLDING THESE TRUST AND SAFETY GUIDELINES AND TO USING EVERY VEHICLE LAWFULLY AND RESPONSIBLY. VIOLATIONS MAY BE SUBJECT TO THE PENALTIES SET OUT IN THE AGREEMENT.
